Minor Parties Risk Dealing Themselves Out of Future Telco Rules: CCC

The minor parties could miss their only chance to have a say in future communications services if they delay considering the Government's telecommunications reform Bill, the Competitive Carriers’ Coalition (CCC) said today.

This is because it is likely that Telstra would try to finalise a deal with the Government, without any Parliamentary oversight, if the Senate put off debate on the Bill before the Parliament at present.

"Some Senators have reportedly said they want to consider the Bill next year rather than in the present Senate sitting session, but do not seem to realise that they are unlikely to see the Bill again," CCC executive director David Forman said.

"Telstra has said it is working with the Government toward a deal on selling parts of its network to the NBNco, and plans to do this before Christmas. The Government has confirmed these negotiations.

"The Bill presently before the Parliament would establish a process for the ACCC to independently examine any such a deal, and stop it if it was unacceptable.

"But there is nothing to stop a deal being made if the Bill has not been passed, and nothing to ensure regions, competition or consumers are properly considered.

"And, if a deal has already been done this year, why would the Government bother to bring the legislation back into the Parliament in 2010?" Mr Forman said.

"The Government seems to have indicated that it is willing to negotiate in the Senate right now.

"This is a chance for minor parties to extract guarantees for regional services, consumer protection and pro-competition rule to be locked in.

"But if a deal is done in December, without the Bill being passed, that chance will be lost," Mr Forman said.

"The CCC itself has proposed amendments to improve the Bill, and we urge the Senate not to fall for the trap of thinking it will get another chance to consider these issues in the New Year.

"The negotiating table appears to be open now. By December, it might be gone," Mr Forman said.
